If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and Funnell API, a service operated in the United Kingdom.
Funnell API is a social media automation platform that enables users to schedule, publish, and manage content across Instagram, Facebook, and YouTube. The Platform also provides AI-powered content generation, analytics, and automated engagement features. We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time.
To use the Platform you must:
Be at least 18 years of age.
Have the legal capacity to enter into a binding agreement.
Not be prohibited from using the Platform under any applicable law.
Have a valid Instagram Business or Creator account, Facebook Page, or YouTube channel to connect to the Platform.
When you create an account on the Platform, you agree to:
Provide accurate and complete information during registration.
Keep your login credentials secure and confidential.
Notify us immediately of any unauthorised access to your account.
Take responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate your account if we reasonably believe your account has been compromised or is being used in violation of these Terms.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:
Use the Platform to publish content that is illegal, defamatory, harassing, abusive, fraudulent, or that infringes the intellectual property rights of any third party.
Attempt to gain unauthorised access to any part of the Platform or its related systems.
Use the Platform in any manner that could damage, disable, overburden, or impair our servers or networks.
Use automated scripts or bots to access the Platform beyond its intended functionality.
Resell, sublicense, or commercially exploit the Platform without our prior written consent.
Use the Platform to violate the terms of service of Instagram, Facebook, YouTube, or any other third-party platform.
The Platform integrates with Instagram, Facebook, and YouTube. By using these integrations, you agree to comply with the respective terms of service of each platform:

Your use of Instagram and Facebook features through our Platform is subject to Meta's Terms of Service and Community Standards.
Google (YouTube)
Your use of YouTube features through our Platform is subject to the YouTube Terms of Service (https://www.youtube.com/t/terms) and Google's Terms of Service.
You retain all ownership rights to the content you create or upload to the Platform. By using the Platform, you grant us a limited, non-exclusive licence to store, process, and publish your content solely for the purpose of providing the services you have requested. We do not claim ownership of your content and will not use it for any purpose beyond operating the Platform.
The Platform uses AI services to generate content on your behalf. You acknowledge that:
AI-generated content is provided as a starting point and may require review and editing before publication.
You are solely responsible for reviewing and approving any AI-generated content before it is published.
We make no guarantees regarding the accuracy, originality, or suitability of AI-generated content.
You assume full responsibility for any content published through the Platform, whether AI-generated or otherwise.
The Platform, including its design, software, features, and all associated content created by Funnell API, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Platform or any of its components without our prior written consent.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:
The Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
The results obtained from using the Platform will be accurate or reliable.
Content published through the Platform will meet the requirements of any third-party platform.
To the fullest extent permitted by applicable law, Funnell API shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of data, loss of revenue, or loss of business opportunity. Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount paid by you to us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Funnell API and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your violation of these Terms or any third-party platform's terms of service.
We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Platform will immediately cease. Sections of these Terms that by their nature should survive termination will do so, including but not limited to sections on intellectual property, disclaimers, limitation of liability, and governing law.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.
